Asylum in the United States is authorized by Section 208 of the Immigration and Nationality Act, codified at 8 U.S.C. § 1158. It allows certain noncitizens who fear persecution on specific protected grounds to remain in the U.S. and obtain lawful status.

Vargas Gonzalez Delombard, LLP does not personally prepare asylum applications; however, we work with attorneys who specialize in immigration experience, focusing on humanitarian protection, including asylum, withholding of removal, and protection under the Convention Against Torture.

What Is Asylum?

To qualify, an applicant generally must show:

  • A well-founded fear of persecution
  • On account of race, religion, nationality, membership in a particular social group, or political opinion
  • By the government or forces, the government cannot or will not control

Asylum can be requested affirmatively with USCIS or as a defense to removal in immigration court.
